L.G. Document Preparation FAQs

Thirty (30) years of experience with three different Bay Area courts. I investigated various petitions for protective proceedings (Guardianships and Conservatorships). As part of that process, I corrected the mistakes of self-represented petitioners and attorneys who were seeking to establish guardianships and conservatorships.

No. Even though I possess a law degree, the cost of my services is less than half the cost of legal counsel.

I can complete your documents and, if desired, file them in court for you. However, I cannot represent you in court; you must appear in court on your own. I can guide you through the court procedures.

A protective proceeding that grants someone the authority to make personal and financial decisions for an adult who has lost the capacity to make them on their own. (see Probate Code Sec. 1801)

A protective proceeding that grants someone the authority to obtain custody of a minor (below age 18) who may be at risk of harm. (see Probate Code Sec. 1510)

A protective proceeding granting someone the authority to make decisions for a developmentally disabled adult (18 years or older). (see Probate Code Sec. 1801 (d))

It includes notary public services for documents to be used in a foreign country. Also includes delivery to California secretary of state for processing.

If you are aware of a child who may be at risk of abuse or neglect, you may seek to establish guardianship and obtain custody of that child. If you are a relative of a child who may be at risk of abuse or neglect, your petition will be investigated by the Court Investigator’s Office. If you are a non-relative, your petition will be investigated by Child Welfare Services. (You are also encouraged to contact Child Protective Services.)

If you have an elderly relative or friend who has lost the capacity to make decisions that are in their best interest or may be at risk of harm or self-neglect, you may file a petition for conservatorship.

A general guardianship or conservatorship investigation can typically be completed in 45 days. However, in an emergency, a temporary guardianship or conservatorship can be obtained within five (5) days.

If you have a developmentally disabled child, you will need to secure legal authority to make decisions on their behalf when the child reaches age 18.

Whenever a petition for guardianship, conservatorship, or limited conservatorship is filed, the Court Investigator’s Office will investigate the appropriateness of your petition and your worthiness to be appointed. This investigation will include a criminal and civil background check and interviews with friends and relatives. They will file a report with the court recommending favoring or denying your petition. The investigator’s office will also charge a fee for the investigation.

No. Those documents have a standard formality. I can prepare the documents for you.
